The High Court of Cassation and Justice declined its jurisdiction and referred the case to the Bucharest Court of Appeal, which prevailed in the sense that the transfer request will be reviewed there. The petitioner had sought, under Article 140 of the Civil Procedure Code, the transfer of a case pending before the Bolintin Vale District Court to another court, citing legitimate suspicion (bănuială legitimă). The High Court ruled that under Article 142(1) of the Civil Procedure Code, requests for transfer based on legitimate suspicion fall within the jurisdiction of the court of appeal in whose circuit the lower court sits, and because the district court is in the Bucharest Court of Appeal's territorial jurisdiction, the latter is the competent forum. The decision is final and without appeal.
