Jurisdiction declined for judge removal request in civil case; matter referred to Court of Appeal
Legislator summary
AI generatedThe High Court of Cassation and Justice declined jurisdiction over a request to transfer a civil case, ruling that the matter must be resolved by the Court of Appeal Galați; this decision is final and without appeal. The dispute involved a procedural challenge filed by a plaintiff against a lower court (Adjud District Court) seeking the removal of a judge based on legitimate suspicion in a civil action initiated after the entry into force of the new Code of Civil Procedure. The decisive legal basis was Article 142(1) of the Code of Civil Procedure, which establishes that requests for case transfer from a district court or regional court fall within the exclusive competence of the appellate court, thereby precluding the supreme court from hearing the application.
