The High Court of Cassation and Justice declined jurisdiction, ordering that the petition to transfer Case No. 27123/280/2014 be referred to the Pitești Court of Appeal, thereby finding that the petitioning party’s request was not within the Supreme Court’s purview. The dispute concerned a jurisdictional challenge filed by a petitioner against a civil case pending before the Pitești District Court, initiated after the entry into force of the new Civil Procedure Code. Relying on Article 142(1) of the Civil Procedure Code, which assigns competence for transfer requests based on legitimate suspicion to the Court of Appeal when the originating instance is a district or district court within its circuit, the Supreme Court determined it lacked subject-matter competence to adjudicate the transfer and without establishing that the statutory condition for its own intervention was met.
