The High Court of Cassation and Justice dismissed as inadmissible a referral for a preliminary ruling submitted by the Brașov Tribunal, thereby leaving the referring court to resolve the matter without a binding supreme court interpretation. The dispute concerned whether a differential treatment in the enforcement of final court judgments—specifically, the voluntary execution of salary surcharge claims for some employees versus the refusal to execute identical claims for others—constituted discrimination under Article 2 of Government Ordinance No. 137/2000 on preventing and sanctioning all forms of discrimination. The court declined to address the substantive legal question regarding the definition of discrimination in the context of disparate enforcement of executable titles for identical labor rights, rejecting the procedural challenge at the threshold.

ÎNALTA CURTE DE CASAŢIE ŞI JUSTIŢIE

Completul pentru dezlegarea unor chestiuni de drept

Minuta deciziei nr. 1 Dosar nr. 3899/1/2015

Şedinţa din 18 ianuarie 2016

ÎN NUMELE LEGII

DECIDE:

521 alin. (3) din Codul de procedură civilă.

Pronunţată în şedinţă publică, astăzi 18 ianuarie 2016.
