The High Court of Cassation and Justice admitted a reference for a preliminary ruling from the Bucharest Court of Appeal and established that an individual enterprise, operating as a legal entity without legal personality under Law No. 44/2008, cannot act as a criminal subject and is therefore not liable for criminal sanctions under Article 135 of the Penal Code. The dispute concerned whether such economic entities, organized by natural persons as entrepreneurs, could be held criminally responsible for offenses committed in the realization of their business objectives. The decisive legal basis relies on the statutory definition of an individual enterprise under Decree No. 44/2008 and the requirement for legal personality under Article 135 of the Penal Code, resulting in a mandatory precedent applicable from the date of publication in the Official Monitor.
