The High Court of Cassation and Justice rejected the petition for the transfer of jurisdiction (strămutare) filed by the plaintiff regarding Case No. 63193/3/2011, thereby upholding the jurisdiction of the Bucharest Court of Appeal and leaving the original court competent to hear the dispute; the decision is final and not subject to appeal. The dispute involved a civil case in which the plaintiff sought to move the trial from the Bucharest Court of Appeal, citing potential bias or impediment, following the rejection of a recusal request and the imposition of a 700 lei civil fine for abusive litigation against the plaintiff on November 4, 2014; the prosecution recommended rejection of the transfer request. The court’s decision was based on the procedural assessment that the legal requirements for transferring jurisdiction were not met, specifically relying on the fact that the prior recusal had been properly adjudicated and that the plaintiff’s subsequent amendments and submissions did not establish a valid legal basis for relocating the case, with the final outcome determined by the application of rules governing judicial recusal and the integrity of the ongoing proceedings.
