Conflict between public information access and personal data protection: Obligation to anonymize personal data instead of denying access
Legislator summary
AI generatedIn a binding preliminary ruling, the High Court of Cassation and Justice admitted the reference and established that a natural person's name and first name constitute personal data under Article 2(1)(c) of Law No. 544/2001 and Article 3(1)(a) of Law No. 677/2001, regardless of whether these details are sufficient to identify the individual. The court held that when public-interest information and personal data coexist in the same document, access to the public-interest information must be granted through the anonymization of the personal data, rendering any refusal to provide access unjustified if such anonymization is possible. This decision interprets and applies the laws on free access to information of public interest and the processing of personal data, resolving the legal conflict between transparency obligations and data protection in cases where both types of information are contained within a single record.
