The High Court of Cassation and Justice dismissed the claimant’s appeal (recurs) as time-barred, affirming the Court of Appeal’s decision, which itself had upheld the trial court’s dismissal of the claimant’s action seeking a declaration that a lease relationship existed with the local council; the appellate decision communicated on 27 July 2006 remained final and irrevocable. The underlying dispute was a commercial and administrative case where the claimant sought judicial recognition of a lease against the municipality and a company, but had lost at both the Tribunal and the Court of Appeal. The decisive legal basis was the mandatory 15-day appeal deadline under Articles 301 and 303(1) of the Civil Procedure Code, computed from communication of the decision, which expired on 11 August 2006; the appeal filed on 17 April 2007 exceeded the deadline, triggering forfeiture (decădere) under Article 103(1), with the court able to raise the tardiness exception of its own motion.

Împotriva acestei ultime hotărâri a declarat recurs reclamanta SC S.B.
