The High Court of Cassation and Justice dismissed the revision petition filed by the appellant as late, leaving the previous decision of the same court intact. The dispute concerned a cassation appeal that the Court had previously dismissed as insufficiently stamped, despite the appellant’s claim that he had paid the stamp duty for the request to reverse enforcement; the appellant sought revision under Article 322(2) of the Civil Procedure Code, arguing that the lower court had failed to rule on a specific request. Applying Articles 324(1) and 322(2) of the Civil Procedure Code, the Court determined that the one-month statutory deadline for requesting revision of a cassation decision had expired between the issuance of the initial decision on May 16, 2014, and the filing of the revision petition on June 18, 2014.

Asupra cererii de revizuire de faţă;
