The High Court of Cassation and Justice, acting as the panel for resolving legal questions, admitted the preliminary reference filed by the Constanța Court of Appeal and established that court costs constitute a principal obligation under an enforcement title, thereby permitting their updating during compulsory enforcement. The dispute concerned the interpretation of enforcement mechanisms in civil proceedings, specifically whether the monetary assessment of judicial expenses could be adjusted to reflect value changes post-judgment. The decisive legal basis is the interpretation of Article 628(3) of the Code of Civil Procedure, which classifies court costs as a principal obligation, applied in conjunction with Article 521(3) regarding the binding nature of such legal interpretations.
