Appeal court's power to remand case or exclude illegal pretrial evidence under former Criminal Procedure Code and dual degree of jurisdiction
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the preliminary question referred by the Court of Appeal Cluj regarding whether an appellate court, reviewing a case tried under the former Code of Criminal Procedure, could order the remittal of the case to the prosecution for redoing the investigation or the act of referral to the court, and whether it could order the exclusion of illegally obtained evidence from the pretrial phase. The dispute centered on procedural rights under the new legal framework, specifically the right to a dual degree of jurisdiction and the application of human rights standards to cases initiated under the old procedural code. The decision rests on the procedural inadmissibility of the reference to the Plenary for the Settlement of Questions of Law in criminal matters, leaving the specific procedural mechanisms and evidentiary exclusions unresolved at this instance.
