Public sector salary reclassification versus effective payment based on reference values and seniority tranches
Legislator summary
AI generatedThe High Court of Cassation and Justice (ICCJ), through its Complete Bench for Resolving Questions of Law, admitted a reference to the Court of Appeal Piteşti and issued a binding interpretative decision establishing the correct legal framework for public sector salary payments. The dispute concerned the application of the Framework Law on salary unification, specifically whether public employees' compensation should be calculated based on effective salary values or merely the reclassified rank. The court clarified that while reclassification is governed by the Framework Law, the actual payment of salary rights must strictly follow the provisions of subsequent specific laws regarding the level of payment for similar functions. Crucially, the decision mandates that payment be determined by reference to rights granted to individuals with the same professional grade and seniority tranche who entered those tranches after the relevant legislation took effect, thereby distinguishing between the administrative act of reclassification and the financial execution of salary obligations.
