The High Court of Cassation and Justice ruled that the appeal on cassation filed by the defendant company is perished, thereby rendering the appellate court's decision final and irrevocable in favor of the plaintiff municipality. The dispute originated from a commercial litigation concerning unpaid rent and late payment penalties for the period of January 2008 to June 2010, where the trial court initially dismissed the claim but the appellate court reversed this, ordering the defendant to pay approximately 233,374 lei. The decisive legal basis was Article 248(1) and (3) of the Code of Civil Procedure, which mandates the automatic perishing of a legal remedy if it remains unprocessed due to the fault of the parties for one year in civil matters; the court found that the proceedings had been suspended for over a year due to the unjustified absence of the parties without any statutory grounds for suspension or interruption under Articles 249–251, leading to the application of Article 312(1) read in conjunction with Article 252 of the Code of Civil Procedure.
