The High Court of Cassation and Justice, sitting as the Panel for Resolving Issues of Law in Criminal Matters, admitted the referral and established that the active subject of the offense defined by Article 16 of Law No. 194/2011 may be any natural or legal person, a ruling that is mandatory for all courts from the date of publication in the Official Monitor pursuant to Article 477(3) of the Code of Criminal Procedure. This decision resolved a legal dispute arising from a criminal case regarding the combatting of operations with products capable of producing psychoactive effects, specifically clarifying whether legal entities could be held criminally liable for the offense in question. The decisive legal basis was the interpretation of Article 16 of Law No. 194/2011, which the court determined encompasses both natural and juridical persons as potential perpetrators.
