The High Court of Cassation and Justice dismissed as inadmissible a referral for a preliminary ruling submitted by the Pitești Court of Appeal, meaning no legal precedent was established and the lower court's procedural request failed. The dispute concerned the interpretation and application of Romania's unified salary laws for state-funded personnel, specifically challenging whether a special law could exclude teaching staff from the unified salary framework to set salaries lower than those paid in December 2009 and April 2011, despite the continued validity of the general salary frameworks. The decisive legal basis for the dismissal was Article 521(3) of the Code of Civil Procedure, which rendered the referral inadmissible, thereby leaving the specific statutory question regarding the conflict between special and general salary legislation unresolved by this superior court instance.
