Commercial eviction appeal held perimé for over-six-month inactivity; eviction order stands.
Legislator summary
AI generatedThe court declared the defendant's appeal (recurs) against the appellate decision perimé (lapsed by peremption) and therefore dismissed it, leaving the lower decisions intact—meaning the plaintiff prevailed and the eviction order stands. The dispute involved a commercial eviction action in which the plaintiff obtained the defendant's eviction from a property; the trial court ruled for the plaintiff, the court of appeal affirmed, and the defendant then filed a further appeal. The proceedings were suspended after neither party appeared, and the case remained dormant for over six months. Under Articles 248(1) and (3) and 252 of the Civil Procedure Code, the court held that any claim or appeal left inactive due to the party's fault for six months in commercial matters is perempted by law, so it found the appeal perimé and irrevocable.

În consecinţă, în baza art. 248 alin.
