The High Court of Cassation and Justice (Civil Section I) declined its own jurisdiction and referred the applicant's motion to transfer the case file (No. 31605/212/2013 of the Constanța Court) to the Constanța Court of Appeal, ruling in favor of that forum. The applicant sought transfer of the case on grounds of legitimate suspicion. Because the underlying case was filed after the new Code of Civil Procedure (Law No. 134/2010) took effect, the court applied Articles 24–25 of the Code and Article 3(1) of Law No. 76/2012; under Article 142(1) of the Code, a transfer request based on legitimate suspicion falls within the exclusive material competence of the court of appeal in whose circuit the lower court sits. The decision is final and not subject to appeal.
