Jurisdiction for revision based on contradictory judgments: higher court relative to the first-instance rendering court
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed its jurisdiction to hear the case, declaring that the Court of Appeal of Timişoara is the competent authority to resolve the matter, with the decision being final and unappealable. The dispute involved a request for revision of a labor and social security law decision, which the petitioner argued was contradictory to three prior civil judgments issued by the District Court. Applying Article 510(2) in conjunction with Article 509(1)(8) of the Civil Procedure Code, the court determined that because the revision was based on a contradiction with decisions rendered by a first-instance court, the petition must be filed before the higher court relative to that first instance, thereby transferring jurisdiction to the Court of Appeal.
