The High Court of Cassation and Justice declined jurisdiction and transferred the case to the Court of Appeal Craiova, which prevailed on the procedural question; no substantive ruling was made. The applicants had requested the transfer (strămutare) of a lower court case from the Craiova Court on grounds of legitimate suspicion, invoking the new Civil Procedure Code. The Court held that under Article 142(1) of the Civil Procedure Code (Law No. 134/2010), a transfer request based on legitimate suspicion is within the jurisdiction of the court of appeal when the court from which transfer is sought is a district court or tribunal in its circuit; therefore, since the underlying case was pending before the Craiova Court, jurisdiction lay with the Court of Appeal Craiova, not the High Court, and the decision was final with no appeal.

D E C I D E
