Revision request sent to prosecutor for preliminary investigation instead of merits ruling
Legislator summary
AI generatedThe High Court of Cassation and Justice (Criminal Section) ordered that the applicant's request for revision (revizuire) of a prior criminal decision be sent to the Prosecutor's Office attached to the High Court for investigation, rather than ruling on its merits. The applicant had filed the revision request directly with the High Court, challenging a 2009 decision that had already dismissed an appeal against a lower court sentence. The court found the request was procedurally misdirected, holding that under Article 397(1) of the Romanian Code of Criminal Procedure, a revision request must be addressed to the prosecutor at the prosecutor's office attached to the court that heard the case at first instance. Consequently, the High Court did not decide the merits but transferred the case for the required preliminary investigation, with the decision subject to appeal.
