Peremption of commercial appeal due to six-month procedural inactivity
Legislator summary
AI generatedThe High Court of Cassation and Justice confirmed the *peremption* (perimare) of the appeal declared by the defendant against a commercial court decision, thereby allowing the lower court's judgment to become final and irrevocable in favor of the opposing party. The case involved a civil-commercial dispute where the defendant had suspended the appeal proceedings on January 30, 2008, and failed to perform any procedural acts for the subsequent six months, resulting in a lapse of the case due to inactivity attributable to the parties. The court ordered the peremption ex officio based on Articles 242(2), 248, and 252 of the Code of Civil Procedure, which stipulate that commercial appeals automatically perish if they remain in a state of inactivity for six months, regardless of whether the request for peremption was made by a party or by the court.
