The High Court of Cassation and Justice (First Civil Section) declined jurisdiction in favor of the Pitești Court of Appeal to hear a request for the transfer (strămutare) of a case pending before the Pitești Court of First Instance, based on claims of legitimate suspicion. The court found that, under Article 142(1) of the new Civil Procedure Code, such transfer requests based on legitimate suspicion fall within the jurisdiction of the court of appeal in whose circuit the lower court sits; because the underlying case was filed after the new code took effect and the lower court is within the Pitești Court of Appeal’s circuit, the latter is the competent forum. The decision is final, with no appeal, and the transfer request remains pending before the Pitești Court of Appeal.

Asupra cererii de faţă, constată următoarele;
