Legitimate-suspicion case transfer referred to Bucharest Court of Appeal
Legislator summary
AI generatedThe High Court of Cassation and Justice (Civil Section I) declined its jurisdiction and transferred the case to the Bucharest Court of Appeal, which is the operative outcome—the applicants' request to transfer Case No. 12169/300/2014 from the Sector 2 Bucharest Court of First Instance, based on legitimate suspicion, must be heard by the Court of Appeal. The dispute involved a procedural motion under the new Civil Procedure Code (Law No. 134/2010), where the applicants sought case transfer on grounds of legitimate suspicion. Decisively, under Article 342(1) of the Civil Procedure Code, such transfer requests are within the exclusive jurisdiction of the court of appeal when the originating court is a lower court (judecătorie or tribunal) within its circuit; hence, applying Articles 131 and 142, the High Court ruled itself materially incompetent and referred the matter to the Bucharest Court of Appeal, with no further appeal permitted.
