The High Court of Cassation and Justice admitted the jurisdictional dispute filed by the Alba Iulia Court of Appeal and ruled that the salary increases of 2%, 5%, and 11% established by Government Ordinance No. 10/2007, as awarded through final and enforceable court judgments, constitute "earned allowances" to be included in the calculation of service pensions for judges and prosecutors. The dispute centered on whether these retroactive salary increments, mandated by the 2007 pay revision for budgetary personnel, qualified for pension calculation under the specific regulatory framework governing the judicial and prosecutorial status. Deciding the matter by interpreting Article 82(1) of Law No. 303/2004 on the status of judges and prosecutors in conjunction with Articles 7(1)-(3) of Government Decision No. 1275/2005 and Article 7 of Law No. 47/1992 regarding the Constitutional Court, the court established that these specific salary components are legally classified as "indemnizaţie avută" and must be taken into consideration when determining the service pensions of magistrates.
