The High Court of Cassation and Justice dismissed as inadmissible the referral submitted by the Bucharest Court of Appeal regarding a preliminary question on labor law interpretation, thereby upholding the admissibility requirements of Article 521(3) of the Civil Procedure Code and leaving the lower court's procedural stance intact. The dispute concerned the scope of protection against dismissal for employees holding elective office in trade unions, specifically whether Article 60(1)(g) of the Labor Code establishes a general prohibition on dismissal with exceptions only for serious or repeated disciplinary breaches, or whether Article 220(2) of the Labor Code limits this protection solely to dismissals motivated by the performance of the union mandate, and whether such protection extends to dismissals due to post elimination. The decisive legal basis involved the interpretation and interplay of Article 60(1)(g) and Article 220(2) of the Labor Code concerning the scope of dismissal restrictions for union representatives.
