The High Court of Cassation and Justice dismissed as inadmissible the reference for a preliminary ruling submitted by the Cluj Court of Appeal, thereby leaving the lower court to resolve the case without establishing a binding national interpretation. The dispute concerned whether a judicial declaration of work performed under special conditions is admissible when the pre-procedural administrative assessment required by specific government norms for the employer and workplace has not been conducted. The Court’s decision rests on the procedural inadmissibility of the reference, failing to address the substantive question regarding the intersection of judicial verification of special working conditions and the mandatory administrative methodology established under Government Decision No. 261/2001, with the ruling being mandatory under Article 521(3) of the Code of Civil Procedure.
