In a mandatory ruling under Article 521(3) of the Code of Civil Procedure, the High Court of Cassation and Justice dismissed as inadmissible a request for preliminary ruling submitted by the Cluj Court of Appeal, thereby leaving the lower court without the requested legal guidance. The dispute centered on whether a court could judicially establish that an employee worked in special conditions for pension purposes, specifically in cases where the employer had already conducted a pre-procedural assessment under Government Decision No. 1025/2003 that failed to cover the specific job title or function performed by the claimant. The court’s decision highlights the procedural threshold for initiating a question of law at the supreme court level in matters concerning the interpretation of labor classification criteria and special working conditions legislation.
