The High Court of Cassation and Justice took formal note of the withdrawal of the petitioner’s complaint against a prosecutor’s ordinance of 24 December 2008 declining to start a criminal investigation and a resolution of 12 January 2009, and ordered the petitioner to pay 100 lei in judicial costs to the state; the withdrawal ends the challenge to those prosecutorial decisions. The case arose from a criminal complaint filed under former Article 278¹ of the Romanian Code of Criminal Procedure challenging the prosecutor’s non-commencement of prosecution and the severance and referral of the case to the anti-corruption prosecution unit; the court had earlier suspended proceedings to refer a constitutional challenge to the provision to the Constitutional Court, which rejected it. The court’s decision was based on the petitioner’s express withdrawal, the binding practice direction of the High Court’s united sections (Decision No. 27/2008) requiring the court to take note of such withdrawal, and the cost-shifting rule of Article 192(2) of the Code; the ruling was subject to appeal (recurs).
