Criminal complaint against prosecutor for abuse of office misdirected to court; referred to competent prosecutor's office
Legislator summary
AI generatedThe High Court of Cassation and Justice ordered the referral of the criminal complaint to the Prosecutor's Office attached to the High Court of Cassation and Justice for investigation, effectively denying the complainant's procedural route through the court. The dispute involved a criminal complaint filed against a senior prosecutor for the alleged offenses of favoring a criminal and abuse of office, stemming from the alleged delay and mishandling of prior complaints since 2006. The court determined that the complaint was procedurally misdirected because, under Articles 222(7), 209(4), and 29(1)(f) of the Code of Criminal Procedure, initial criminal complaints against prosecutors must be submitted to the competent prosecutorial authority rather than directly to the judiciary.
