The High Court of Cassation and Justice declared the appellant’s appeal lapse (perimare) without examining the merits, leaving the lower court judgments final and irrevocable. The underlying dispute involved a commercial entity in liquidation seeking court orders to compel a former director to hand over company seals, registers, and financial records, with the trial and appellate courts initially granting the request and awarding statutory damages for delay. The appellant appealed to the High Court on grounds of illegality, primarily requesting the suspension of the lower court decision pending the resolution of a parallel related case. Relying on the procedural provisions regarding the suspension of proceedings and the lapse of time, specifically Article 248 of the Code of Civil Procedure, the court determined that more than six months had elapsed since the suspension order and neither party had filed a request to re-instate the case, thereby establishing the legal basis for the lapse of the appeal.
