The High Court of Cassation and Justice declared itself materially incompetent and declined jurisdiction, referring the case to the Court of Appeal Ploiești, thereby leaving the Court of Appeal’s 2012 final decision, which had dismissed the underlying claim as unfounded, in force. The dispute involved a petition for revision (*revizuire*) filed by a party against the appellate decision, but the petitioner failed to invoke the specific statutory ground under Article 322(7) of the Code of Civil Procedure that would confer competence on the High Court as the superior instance. Relying on Article 323(1) of the Code of Civil Procedure, which stipulates that the revision petition must be addressed to the court that rendered the final decision absent the exceptional grounds in Article 323(2), the Court held that jurisdiction remained with the Court of Appeal Ploiești, the original issuing authority.

323 alin. (1) C. proc. civ., Înalta Curte va declina competenţa de soluţionare a cererii de revizuire a Deciziei civile nr. 2993 din 19 septembrie 2012 a Curţii de Apel Ploieşti, secţia I civilă, formulată de revizuentul V.V., în favoarea Curţii de Apel Ploieşti, secţia I civilă.
