The High Court of Cassation and Justice, sitting as the Panel for Resolving Issues of Law, admitted the referral from the Craiova Court of Appeal and established that a final judicial decision annulling a normative administrative act produces effects on individual administrative acts issued under that normative act, even if those individual acts were already subject to pending litigation when the annulment was published; the decision is binding on all courts pursuant to Article 521(3) of the Code of Civil Procedure. The dispute concerned the legal interpretation of administrative litigation procedures, specifically whether the invalidity of a general regulatory act automatically affects specific administrative decisions taken based on it during ongoing trials. The decisive legal basis is the interpretation of Article 23 of Law No. 554/2004 on Administrative Litigation, clarified through the mechanism of resolving issues of law under Article 521 of the Code of Civil Procedure.
