Unpaid goods and penalties: appeal annulled for lack of stamp duty, upholding first-instance judgment
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the defendant's appeal for lack of stamp duty, rendering the appellate court's decision final and upholding the plaintiff's victory. The case involved a commercial dispute where a state-owned company sued a private limited liability company for unpaid goods, penalties, and litigation costs; the first instance court granted the claim, and the appellate court dismissed the defendant's appeal on the merits. The decisive legal basis was the procedural requirement under Law No. 146/1997 that court fees must be paid in advance or by the hearing date; because the defendant failed to pay the stamp duty for the appeal, the Supreme Court applied the doctrine of non-stamped appeals to annul the filing rather than examining its substantive grounds.
