Appeal annulled for insufficient stamp duty in civil dispute between companies
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the appeal filed by the plaintiff company against the Appellate Court’s decision, which had previously dismissed the plaintiff's appeal against a first-instance judgment in favor of the defendant companies; consequently, the lower court rulings remain in force, and the appellant was ordered to pay litigation costs of 2,380 lei to one of the defendants. The dispute arose from a civil matter where the plaintiff challenged a prior judgment but failed to comply with procedural requirements regarding the prepayment of the judicial stamp tax, despite being legally notified to regularize the payment within the statutory deadline. The court applied Article 20(3) of Law No. 146/1997 and Article 274 of the Code of Civil Procedure, determining that because the appellant did not qualify for any exemption or deferral of the stamp duty, the appeal was procedurally defective and subject to annulment as insufficiently stamped.

Văzând şi art. 274 C. proc. civ.;
