The High Court of Cassation and Justice, sitting as the Panel for Settling Questions of Law, admitted the referral from the Pitești Court of Appeal and established a mandatory legal principle that voluntary installment payments made pursuant to Emergency Government Ordinance no. 71/2009 (as approved with modifications by Law no. 230/2011) for arrears owed to public sector personnel do not interrupt the statute of limitations for the material right to claim interest or moratory damages. This decision resolves a procedural dispute concerning whether such statutory-based repayments of wages constituted acts that legally reset the prescriptive period for ancillary financial claims. The court’s ruling is grounded in the interpretive authority of Article 521(3) of the Code of Civil Procedure, which mandates that the established legal solution binds all lower courts in similar cases.
