The High Court of Cassation and Justice, acting through its Panel for Resolving Questions of Law in Criminal Matters, issued a mandatory binding interpretation admitting the preliminary question raised by the Court of Appeal of Craiova and ruling that the condition of typicity for the crime of organized criminal group is not met when the underlying targeted offense has been decriminalized by the entry into force of the new Penal Code. The dispute concerned the applicability of the constituent elements of the organized criminal group offense under the circumstances of legislative changes to criminal liability. Relying on Articles 367(1) and (6) of the Penal Code, the Court decisively established that the decriminalization of the predicate offense removes an essential characteristic of the organized criminal group crime, thereby precluding the fulfillment of the requirement of typicity and resulting in the inapplicability of the charge.
