The High Court of Cassation and Justice dismissed as inadmissible the request for a preliminary ruling filed by the Military Court of Appeal concerning the interpretation of judicial organization laws in criminal proceedings. The dispute involved a referral to resolve a question of law regarding the applicability of Articles 58(2) and (3) of Law No. 304/2004 on the Judiciary, specifically in the context of adjudicating complaints against decisions not to prosecute or not to send to trial, grounded in Articles 340 and 341 of the Code of Criminal Procedure. By rejecting the referral, the Court determined that the preliminary ruling mechanism was not applicable to the specific procedural challenge raised, leaving the lower court to resolve the matter under existing procedural rules without a binding unified interpretation from the supreme court.
