Legislator summary
AI generatedThe court transferred the revision request to the Prosecutor's Office attached to the High Court of Cassation and Justice, without ruling on the merits, and the decision is subject to appeal. The applicant had filed the revision petition directly with the court, bypassing the mandatory procedure under Articles 397 and 399 of the Romanian Code of Criminal Procedure, which requires that such requests be submitted to the prosecutor of the court that heard the case at first instance, who must conduct preliminary inquiries before transmitting the file and conclusions to the competent court. The court found that the direct filing violated this procedural requirement and, under Article 397, ordered the referral to the competent prosecutor's office.

Asupra cererii de revizuire de faţă;
În baza lucrărilor din dosar, constată următoarele:
Potrivit art. 394 alin. (1) lit. a)-e) C. proc. pen.
