The High Court of Cassation and Justice took note of the complainant’s unilateral withdrawal of the criminal complaint and dismissed the case, ordering the complainant to pay 200 lei in judicial expenses to the state. The dispute involved a criminal complaint alleging multiple offenses, including abuse, abuse of power, and corruption, allegedly committed by prison authorities during the execution of the complainant’s custodial sentence for robbery; the complainant personally withdrew the complaint on the day of the hearing. The court relied on the doctrine that the withdrawal of a complaint is a unilateral act of will, applying Article 192(2) of the Code of Criminal Procedure to mandate the collection of judicial costs from the withdrawing party.
