Asupra cauzei de faţă constată următoarele:

Prin cererea înregistrată pe rolul Înaltei Curţi de Casaţie şi Justiţie, secţia I civilă, la data de 17 noiembrie 2014, petenta D.M. a solicitat strămutarea Dosarului nr. 1038/288/2014 al Judecătoriei Râmnicu Vâlcea la o altă instanţă egală în grad, pe motive de bănuială legitimă.

Conform verificărilor efectuate în sistemul informatic Ecris, dosarul ce face obiectul cererii de strămutare de faţă a fost înregistrat pe rolul Judecătoriei Râmnicu Vâlcea la data de 2 februarie 2014, dată la care erau aplicabile dispoziţiile Codului de procedură civilă, aprobat prin Legea nr. 134/2010.

Potrivit art. 142 alin. (1) Cod de procedură civilă, „cererea de strămutare întemeiată pe motive de bănuială legitimă este de competenţa curţii de apel, dacă instanţa de la care se cere strămutarea este o judecătorie sau un tribunal din circumscripţia acesteia ..".

Or, în cauză, în susţinerea cererii de strămutare deduse judecăţii s-au invocat, aşa cum s-a arătat anterior, motive de bănuială legitimă, iar cererea este formulată cu privire la un dosar înregistrat ulterior intrării în vigoare a noului Cod de procedură civilă pe rolul Judecătoriei Râmnicu Vâlcea, instanţă aflată în circumscripţia teritorială a Curţii de Apel Piteşti.

Pentru aceste considerente, în aplicarea dispoziţiilor art. 131 raportat la art. 142 C. proc. civ., instanţa competentă material a soluţiona cauza este Curtea de Apel Piteşti, instanţă în favoarea căreia va opera prezenta decimare de competenţă.
