Decriminalization of 11-90 day negligent bodily harm under 2014 Penal Code transition
Legislator summary
AI generatedThe High Court of Cassation and Justice, acting as the Full Bench for Resolving Questions of Law, issued a binding ruling that decriminalized a specific category of negligent bodily harm effective from February 1, 2014. This decision resolved a legal conflict initiated by the Bucharest Court of Appeal, which sought clarification on the applicability of the 1969 Penal Code versus the new 2014 Penal Code for acts of negligent injury causing 11 to 90 days of medical care. The Court determined that under the 1969 Penal Code, negligent bodily harm resulting in these intermediate injuries was a criminal offense, but because the 2014 Penal Code strictly limits criminal liability for negligent harm to cases involving the conditions outlined in Article 196, paragraph 1, the narrower category of injuries covered by Article 184, paragraph 2 and 4 of the 1969 Code lacks a counterpart in the new legislation. Consequently, the Court held that such acts are decriminalized under the current legal framework, establishing the decisive legal basis that the new Code’s stricter criteria for penalizing negligence supersede the broader scope of the prior legislation.
