Commercial appeal extinguished by peremption due to statutory inaction
Legislator summary
AI generatedThe High Court of Cassation and Justice ruled in favor of the plaintiff (implicitly, by dismissing the appeal) by declaring the appeal filed by the defendant commercial company time-barred (perimed), thereby rendering the lower appellate court's decision irrevocably effective. The dispute arose from a commercial case where the defendant's appeal against the Court of Appeal's judgment had been suspended in October 2009, and the proceedings remained in a state of inaction (*nelucrare*) due to the parties' negligence. The court applied Articles 248 and 252 of the Code of Civil Procedure, determining that the one-year statutory period for inaction in civil matters had elapsed without any procedural acts being performed, thus triggering the automatic extinction of the appeal.
