Jurisdiction of change-of-venue motion in post-2013 civil proceedings: application of New Code of Civil Procedure to incidental requests
Legislator summary
AI generatedThe High Court of Cassation and Justice, Civil Section I, dismissed its own competence and transferred the case to the Oradea Court of Appeal. The dispute concerned a motion for change of jurisdiction (transfer of venue) filed on the grounds of legitimate suspicion, regarding an underlying application for public legal aid that was registered with a local court on October 23, 2013. The Court held that because the underlying proceedings commenced after the entry into force of Law No. 134/2010 (New Code of Civil Procedure), the new procedural rules applied to the incidental motion. Relying on Article 142(1) of the New Code of Civil Procedure and the uniform interpretation established in a plenary session of June 18, 2012, which affirmed that incidental motions in post-enactment cases are subject to the new Code, the Court determined that a change of jurisdiction request from a court of first instance falls within the exclusive competence of the Court of Appeal corresponding to that court's circuit.

Constată că cererea de ajutor public judiciar, ce face obiectul cererii de strămutare a fost înregistrată pe rolul Judecătoriei Arad la data de 23 octombrie 2013, după intrarea în vigoarea a Legii nr. 134/2010 (Noul C. proc. civ. - NCPC);
În raport de dispoziţiile art. 142 alin. (1) din actul normativ menţionat potrivit cu care „ cererea de strămutare întemeiată pe motiv de bănuială legitimă este de competenţa curţii de apel, dacă instanţa de la care se cere strămutarea este o judecătorie sau un tribunal din circumscripţia acesteia";
