The High Court of Cassation and Justice (Section I Civil) declined its jurisdiction and referred the case to the Court of Appeal Craiova, which prevailed on the jurisdictional issue; the applicant's request to transfer a case from the Slatina District Court to another equal court on grounds of legitimate suspicion remained pending before the appellate court. The applicant filed the transfer request under the new Civil Procedure Code, which applied because the underlying case was registered at the Slatina District Court on 8 August 2013, after the code's entry into force. The Court held that, under Article 142(1) of the new Civil Procedure Code, a transfer request based on legitimate suspicion falls within the exclusive competence of the court of appeal in whose territorial jurisdiction the lower court is located, and since the Slatina District Court is in the territorial jurisdiction of the Court of Appeal Craiova, that appellate court was the proper forum; the High Court declined its competence accordingly, with no appeal available.
