The High Court of Cassation and Justice dismissed as inadmissible the revision request filed by a limited liability company against a commercial appeal court decision, thereby upholding the lower tribunal's judgment which had reversed a first-instance sentence in favor of the opposing joint-stock company. The dispute centered on a motion for revision of an irrevocable commercial judgment, where the petitioner alleged the appellate court erred in admitting the opponent's appeal without proper legal basis and contrary to the underlying contractual terms. The court held that the statutory grounds for revision under Article 322(1), (2), and (7) of the Civil Procedure Code were not met, specifically noting that the petition lacked the requisite contradictory irrevocable judgments between the same parties required for revision under Article 322(7), and instead improperly challenged the substantive reasoning and contractual interpretation of the original decision.

322 pct. 1 și 2 C. proc. civ.

PENTRU ACESTE MOTIVE

ÎN NUMELE LEGII
