Transfer of case file on legitimate suspicion referred to Constanța Court of Appeal; High Court declinatory ruling final.
Legislator summary
AI generatedThe High Court of Cassation and Justice (Section I Civil) declined its own jurisdiction and transferred the case to the Constanța Court of Appeal, which thus prevails on the procedural point; no other relief was granted, and the transfer is final with no appeal. The dispute arose from a request by a company to have case file no. 31601/212/2013 of the Constanța District Court transferred to another court of equal rank on grounds of legitimate suspicion, filed after the entry into force of the new Civil Procedure Code. The court applied Article 142(1) of the new Civil Procedure Code, which grants jurisdiction over transfer requests based on legitimate suspicion to the court of appeal within whose circuit the lower court sits; because the underlying case was registered with the Constanța District Court after the new code took effect, and that court lies within the Constanța Court of Appeal's territorial jurisdiction, the High Court held it lacked material competence and referred the matter accordingly under Article 131 and Article 142 of the code.
