Revision appeal dismissed for missing identity of parties; appeal held late under 15-day deadline
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appeal as untimely, leaving in force the Court of Appeal’s judgment that had previously rejected the revision request. The dispute concerned a revision application filed by a limited liability company against two lower court orders, which the appellate court had denied on the grounds that the challenged decisions were not rendered in the same case between the same parties with the same legal capacity, failing to meet the conditions of Article 322(7) of the Civil Procedure Code. The decisive legal basis for the final ruling was Article 301(1) of the Civil Procedure Code, under which the appeal was filed 15 days after the communication of the judgment, thereby exceeding the statutory deadline for lodging an appeal.
