The High Court of Cassation and Justice declines its jurisdiction and transfers the case to the Bucharest Court of Appeal, which is the competent court to rule on a request for case transfer (strămutare) based on legitimate suspicion. The request concerns a case pending before the Oltenița District Court, filed on 2 June 2014, after the new Civil Procedure Code entered into force on 15 February 2013. Under Articles 142(1), 24, and 131 of the new Civil Procedure Code, a transfer request based on legitimate suspicion falls within the jurisdiction of the court of appeal when the court from which transfer is sought is a district court or tribunal within its circuit; therefore, the Bucharest Court of Appeal must adjudicate the matter. The decision is final and not subject to appeal.
