Eligibility of 50% annual score bonus for special working conditions performed after 2001 in public pension calculations
Legislator summary
AI generatedThe High Court of Cassation and Justice partially admitted a reference on a preliminary legal issue, establishing that the 50% annual score bonus under Article 169(6) of Law No. 263/2010 does not apply to individuals who performed work under special conditions after April 1, 2001, but were registered for a pension before the law entered into force; it simultaneously rejected as inadmissible the reference regarding the interpretation of Article 169(3) in relation to Article 169(1) concerning persons retired between April 1, 2001, and November 2, 2008. The dispute concerned the calculation of public pensions and the retroactive application of score bonuses for special working conditions under the unified pension system. The decisive legal basis was the interpretation of Articles 169(3) and 169(6) of Law No. 263/2010 on the unified public pension system, with the operative decision being binding on the referring court pursuant to Article 521(3) of the Code of Civil Procedure.
