The High Court of Cassation and Justice dismissed the appeal as null and void, leaving the prior appellate decision in force, after finding the appellant's procedural challenge fundamentally defective. The dispute involved an administrative law matter where the appellant filed a cassation appeal against a decision of the Bucharest Court of Appeal, but the appellant failed to provide legal grounds for the appeal and subsequently consumed the single allowed opportunity for a hearing postponement due to unrepresented parties. The court applied Articles 156(1), 303(1), and 306 of the Civil Procedure Code, determining that an unmotivated appeal request, coupled with the exhaustion of the limited procedural extensions for defense, results in the automatic nullity of the appeal, thereby precluding any substantive review of the administrative issue.

Asupra recursului de față;
